The Michigan Secretary of State may suspend and/or revoke your driving privileges for a variety of reasons. Suspensions are usually issued for accumulation of 12 or more points, reckless driving, or refusal to submit to a DataMaster breath test required by the Michigan Implied Consent Law. A suspension only restricts driving privileges for a certain period of time, after which the privilege is automatically restored.
Revocations, which are usually issued for the accumulation of multiple drunk-driving offenses, do not provide for automatic reinstatement.Revoked drivers are required to petition the Driver’s License Appeal Department (DLAD) to obtain restricted driving privileges. The burden of proof is upon the petitioner to present clear and convincing evidence that any substance abuse or dependency is under control and likely to remain under control. Additionally, the petitioner must show that there is a low or minimal risk of repeating prior abusive behavior. Should the DLAD deny the petition, an appeal to the Circuit Court in the county where the petitioner resides is available. If an appeal is not taken, the petitioner will have to wait 12 months before filing another petition with the DLAD.
