Minor in Possession (MIP) citations are given to those under the age of 21 who are in possession of alcohol (possession meaning actually in contact with an alcoholic beverage or having a positive BAC (blood alcohol content). An MIP is a misdemeanor and will remain on your record for the rest of you life.
Penalties for MIP’s include:
- First Offense
- Diversion possible (explained below)
- A fine of up to $100.00
- Substance abuse prevention, treatment or rehabilitation
- Community service
- If you are under 18, your parents will be notified
- Second Offense
- Up to 30 days in jail, upon violation of your probation
- Driver’s license suspension for 90 days
- A fine of up to $200.00
- Substance abuse prevention, treatment or rehabilitation
- Community service
- Mandatory drug testing
- Third Offense
- Up to 60 days in jail, upon violation of your probation
- Driver’s license suspension for one (1) year
- A fine of up to $500.00
- Substance abuse prevention, treatment or rehabilitation
- Community service
- Mandatory drug testing
These penalties can be even greater if you have a previous criminal record. However, the State of Michigan will sometimes allow for the discharge and dismissal of a first MIP offense if certain conditions are met, including no priors, proper counseling and community service. This is known as the diversion provision.
