CRIMINAL LAW DEFENSE

Criminal Law was enacted to prevent harm to society and identifies conduct that is criminal or in violation of societys rules. Additionally, Criminal Law sets out the punishments for undesirable conduct. Criminal sanctions include monetary fines, probation, incarceration or death (depending on the jurisdiction). This differs from civil liability, where the remedy is most commonly monetary damages.

DRIVER’S LICENSE RESTORATION

The Michigan Secretary of State may suspend and/or revoke your driving privileges for a variety of reasons. Suspensions are usually issued for accumulation of 12 or more points, reckless driving, or refusal to submit to a DataMaster breath test required by the Michigan Implied Consent Law. A suspension only restricts driving privileges for a certain period of time, after which the privilege is automatically restored.

Revocations, which are usually issued for the accumulation of multiple drunk-driving offenses, do not provide for automatic reinstatement.Revoked drivers are required to petition the Driver’s License Appeal Department (DLAD) to obtain restricted driving privileges. The burden of proof is upon the petitioner to present clear and convincing evidence that any substance abuse or dependency is under control and likely to remain under control. Additionally, the petitioner must show that there is a low or minimal risk of repeating prior abusive behavior. Should the DLAD deny the petition, an appeal to the Circuit Court in the county where the petitioner resides is available. If an appeal is not taken, the petitioner will have to wait 12 months before filing another petition with the DLAD. Kelly Law Offices, P.C. can assist you with the following license restoration issues:

WORKERS’ COMPENSATION

Workers compensation laws are designed to ensure payment by employers for some part of the cost of injuries, or occupational diseases, received by employees in the course of their work. Workers compensation legislation requires the employer to furnish a reasonably safe place to work, suitable equipment, rules and instructions when they are reasonably necessary and reasonably competent foremen and superintendents. The employer is liable for an employee’s acts of negligence, for the employers own gross negligence, and for extraordinary risks of work. In most cases the employer is not liable for accidents occurring outside the place of work, or for those which have not arisen directly from employment.

MEDICAL MALPRACTICE

Medical malpractice is an act or omission by a health care provider which deviates from accepted standards of practice in the medical community and which causes injury or death to the patient. Simply put, medical malpractice is professional negligence (by a health-care provider) that causes an injury.

ESTATE PLANNING

The process of planning for the efficient transfer of assets at one’s death. Estate planning begins with preparing a will and may also include naming a power of attorney, establishing trusts and making pre-death gifts.
